Virginia student facing assault charge

It is no secret that sometimes children act foolishly without considering the potential consequences they might be facing. Even the most innocent of behaviors can be seen as violent and lead to criminal charges.

For instance, according to a recent report, a 14-year-old middle school student was recently charged with assault after an alleged school-related crime involving a teacher. The student stated that she saw a teacher she had last year in the hallway after class. The student then took a baby carrot out of her pocket and threw it towards the teacher. The teacher was hit in the forehead, though the student did not plan for that to happen.

A baby carrot may not be the first thing most people think of when they think of a weapon. Nevertheless, the student is now facing assault and battery with a weapon after the incident. The student’s attorney pointed out that offensive and unwanted touching, not necessarily injury, is required for a battery. Whether the carrot was raw or soft may also make a difference in the severity of the crime.

The student has been suspended from school and has been out of school for about a month since the incident. Her mother stated that the disciplinary review board sent a letter home to get the student to admit guilt, but they declined. The student is now awaiting a summons to find out the next steps.

Incidents like these prove that young people can end up in terrible situations, even when they have no ill-intent. Coming up with an effective defense strategy will help protect children and teens from the serious consequences that may await them if they are found guilty.
